These General Terms and Conditions govern the relationship between Grafix Solutions Ltd, hereinafter referred to as "Provider", and each client of Grafix Solutions Ltd, hereinafter referred to as "User", using its services, agrees to comply with the following terms and conditions of use:
The Provider reserves the right to modify, delete and edit the Terms of Use at any time, and the relevant changes will be published at this address. Notices of violation of these Terms of Use shall be sent to [email protected].
The Provider shall not be held liable in case an email message sent by the Provider ends up in SPAM or any other directory/folder of the customer's email address.
The Provider expressly prohibits the placement of the following types of content, such as files or links, on hosted websites:
- Torrent links (Torrent tracker)
- psyBNC, IRC and similar applications
- Pornographic publications
- Warehouse content
- Hacking programs or archives
- Software for sending SPAM messages
- Copyright-free content
- File download
- Background processes (proxy server, chat sessions)
- Rating sites and systems, file/image sharing platforms
- Content that violates Bulgarian law
- European legal norms
- Scripts or programs aimed at DDoS (Denial of Service)
- Perl or Python based applications and scripts that may cause unwanted effects on our system are automatically penalized by our uploaded file format monitoring and file system securing system.
- Pages that target a gaming server (Counter-Strike, Minecraft, World of Warcraft, GTA, etc ).
Server limits and restrictions:
A shared hosting service implies the use of the resources of one server by a certain number of users. In order to avoid one user consuming too many resources at the expense of the others, the following limitations have been introduced for each individual hosting package:
The space provided by the Supplier may not be used solely for backup purposes. This applies only to services falling under the category "Shared Hosting". The space may only be used for the needs of the websites hosted on the User's hosting account. Users who violate these terms will be notified by email and given 24 hours in which to take appropriate action. If the violation is not ceased within the given period, the hosting account will be suspended.
The provider is not responsible for changes that are caused by additional software such as cPanel, LiteSpeed, Softaculous and others.
The provider is not responsible for the correct operation or limitations that are provided by third parties such as cPanel, LiteSpeed, Softaculous and others.
Each individual database uploaded by the User may not exceed the limit of 1GB (1,024 MB). Users who violate this condition will be notified by email and given 24 hours within which to take appropriate action. If the violation is not stopped within the given time period, the hosting account will be suspended.
The Supplier is obliged to notify the User of upcoming actions on his part.
Use of multimedia streaming and the support offered by the Provider
Media streaming comes in the form of FFmpeg/ Xvid/ MP4Box support along with a PHP module for FFmpeg that your applications can use. The following actions are limited where the client can be restricted:
- Attaching and reformatting a video of more than 200 MB
- Attaching and reformatting videos more than 1 at a time
- Using the Video Formatting and Remaking support we have provided to all customers for use in creating sites like Vbox/YouTube on shared hosting
- Using FFmpeg technology to create a site that contains licensed material or erotic videos
Sending e-mails and possible restrictions:
The sending of unsolicited mass, commercial messages (Commercial Messages) via the Internet (also called SPAM) from servers belonging to the Provider is expressly prohibited. The Provider reserves the right to impose a sanction upon detection of a SPAM offender - removal of the User (account) without warning. Any subsequent solicited or unsolicited commercial message after 300 (three hundred) sent within 1 hour or more than 20 e-mail messages in 1 minute, whether sent via e-mail software application on the User's home computer or via a web-based software application such as phpList/ ccMail, etc. will also be considered "SPAM".
In case of sending unsolicited messages via contact or registration forms, the Provider reserves the right to limit the e-mail service to the customer.

- Sending e-mails when using the VPS Hosting service is not limited, but sending e-mails too fast or too massively can lead to unpleasant restrictions from global e-mail providers such as MSN/ Yahoo/ Google.

Unmanage VPS servers
Unmanage VPS is a service where the User gets full access to it and manages it independently. This includes both the content itself, which is hosted on the service, as well as the adjacent Operating System, System Servers, etc.
If a problem arises, the User may consult the Provider for a possible solution, but the latter is not obliged to take action.
The provider is not responsible for the content hosted on this type of service, which is managed by the user.
Manage VPS servers
Manage VPS is a service where the User gets limited access to it. The care of the server itself, operating system, system servers, etc. is assumed by the Provider. Also, if necessary, additional, non-standard servers can be placed if various factors (operating system, control panel or others) allow it.
The Provider is not responsible for the content that the User has placed on this service.

The supplier aims to respond to your first enquiry within 15 minutes, after which, due to a number of factors, a prompt response cannot be guaranteed.
Security and daily scanning of hosting services
The Provider undertakes to scan and review with antivirus and other available programs the content of customers who use Shared Hosting.
The User agrees to be responsible for his/her files and their status if he/she uses a VPS Hosting service without support from the Provider.

User agrees that limitation or interruption of its service, whether VPS or Dedicated Server, may be caused by failure to adequately maintain the service.
Backup feature for shared hosting services
The Daily Backup Service for Shared Hosting is provided voluntarily by the Provider. The Provider's platform performs multiple backups/ backups on its own equipment on a set period at its own discretion. Typically 7 backups are retained.
The Supplier shall keep the records made by itself for its own needs in case of force majeure, technical problems in the Supplier's equipment, acts or omissions of third parties and organizations aimed at harming the Supplier.
The Provider encourages the User to additionally store the information located on the space provided for its use on remote media and/or devices.
The provider reserves the right to exclude files of large size, specific extensions or certain directories when creating backups and files uploaded for backup purposes in order to avoid system overload.
We apply some, but not all extensions that are not included in Backup backup - tgz, rar, zip, mp3, mp4, avi, iso, bakm mov, sql, gz and others.
Using SFTP/ SSH connection protocol
The user agrees that any of his/her actions may be recorded in system logs.
The user agrees that any action against the system or against the security of the system may result in the deactivation of his service.
The user is responsible for any actions that third parties may perform using his key or password.
Uptime/ Keeping the service sites up and running
The Provider agrees and undertakes to maintain the sites of all Users in good order according to the terms of use of the Services already described.
The provider is not responsible for conditions beyond its control that cause an interruption in service, for example:
- A problem caused by a user who violated the terms of service and caused the global network to limit the connectivity we offer for general use;
- A problem caused at the hardware level that cannot be controlled and fixed in the normal 10-20 minutes under software factors;
- A problem caused by attacks or incorrect user settings.
The provider is not responsible if client sites reach server limits and system security automatically temporarily disables the pages.
The Provider shall not be liable in the event that a User reaches server limitations and internal systems temporarily restrict access to a web page in order to maintain the quality of the service offered.
The Provider is obliged to review the exact reason why the interruption of access to the service occurred and to assist the User as much as possible within the permissible limits.
The Provider shall be obliged to explain in detail the reason for any interruptions of the services used by the User.
The Provider shall not be held liable if the User cannot establish a connection to its service, unless the reason lies with the Provider itself.
The Supplier shall not be liable in the event of force majeure such as fire, flood, emergency, war, blockade, earthquake, etc.
The Customer shall be obliged to conduct any correspondence with third parties with whom it has a contractual relationship when troubleshooting a problem related to the applications hosted on the Provider's servers. The Provider may request additional information intended to supplement that originally submitted by the Customer and intended to further clarify the cause of the issue or problem.
Domain registration, renewal and transfer
In order to use the Services provided, the User must register by providing the necessary information when filling in the registration form and pay the relevant subscription fee.
The full activation of the domain takes place within two days of its entry in the Internet domain name registries.
The Provider shall not be held liable in cases where the data provided by the User is incorrect, incomplete or inaccurate and this has led to the refusal of registration.
The Provider gives the User the opportunity to renew the period for which the domain chosen by the User is registered, as before the expiration of the domain registration period requested by the User, the Provider sends reminder e-mails to the e-mail address provided by the User.
The Supplier shall not be liable if the User has not received the reminder letter because he has provided wrong or inaccurate e-mail addresses or has changed his e-mail addresses and has not notified the Supplier thereof.
The Provider shall not be liable if, after the expiration of the registration period, the domain name has been claimed and/or registered by a third party, the price for a new registration or renewal is higher, the domain is not functioning or has been deleted from the registries due to the User's failure to pay in a timely manner for the renewal of its registration.
A domain cannot be transferred out before it has been registered for 60 days.
A domain cannot be transferred out once it has expired or less than two weeks remain before the expiration date.
Jump.BG does not offer premium domain registration.
Jump.BG registers domains with a name length of at least 3 (three) characters. If this condition is not met, the application will be invalid.
Jump.BG registers .bg domains with name length between 3 (three) and 63 (sixty-three) characters.
Persons under 18 years of age may not register a domain name with the .bg/.bg extension.
Some domain extensions have a grace period during which the domain name can be renewed at its standard price. Jump.BG does not determine the presence or absence of such a period, as well as its duration.
The Provider shall not be liable in the event that the Registrar imposes a penalty fee for the renewal of a domain name after its expiration period. The fee itself is determined by the Registrar General
The Provider undertakes to retain the content of suspended accounts to the shared hosting services for 45 days. The data retention time on virtual servers that are not renewed or are suspended is 30 days.
Intellectual property
The materials provided on this website, including without limitation all editorial materials, photographs, illustrations and other graphic materials, names, logos, trademarks and service marks, are the property of Provider and are protected by copyright and other intellectual property laws.
The Provider reserves the right to restrict or completely exclude sites that use another's intellectual property for one reason or another on its website without the consent of the actual owner, who may offer this property for a fee.
The provider does not provide any information about its customers to third parties (other than public Whois domain information). The only exception is if it is requested by official authorities court and prosecution. The user agrees that the Provider may use the personal data provided for the purpose of delivering and supporting the services offered.
The Supplier and the User undertake never to make public any written or oral correspondence between them. Correspondence should not be published in print or electronic media (including websites).
The provider is not responsible for any changes in the type or functionality of external providers, such as cPanel, LiteSpeed and others.
Price of services
The user shall have the right within 30 calendar days to withdraw from the use of the service and to terminate the contract without notice and without giving any reason. After termination of the contract, the amount paid for the purchased services shall be returned to the user. For this purpose it is necessary to fill in STANDARD FORM FOR EXERCISING THE RIGHT OF WITHDRAWALwhich can be found HERE, or to state unambiguously in another way the decision to cancel the service (sending a message within the mentioned time limit) Services whose fees are not refundable according to Article 57, paragraph 1 of the Consumer Protection Act are all products from the following categories: domain name registration, SEO services, SSL certificates.
In case of cancellation of the provided service, all purchased additional licenses such as cPanel, LiteSpeed, Cloudlinux and others are non-refundable.
Additional services concerning .bg domain names or radio hosting are also non-refundable.
You may cancel your service after the initial 30 days only at the end of its paid period.
The refund period is up to 14 calendar days.
When the user makes a bank payment, he is obliged to enter the number of the pro forma invoice issued to him in the "Reason" field. If the field is not filled in correctly, the supplier is not liable if the payment is not accounted for on time.
Any payment received that cannot be accounted for by the Supplier will be refunded to the appropriate payer.
The user has the right within 30 (thirty) calendar days from the start of the service to withdraw from its use and terminate the contract without notice and without giving a reason for doing so.
Payment method
Through PayPal - in accordance with the PayPal payment terms available at www.paypal.com. The payment process is carried out entirely within PayPal's system and subject to their terms and conditions. Once the payment process is complete, PayPal's system automatically redirects you back to the Platform. Access to the Service will be granted upon confirmation from PayPal of a successful payment
Through the ePay.BG system - in accordance with the ePayment terms and conditions available at www.epay.bg. The payment process is carried out entirely within the ePay system and in compliance with their terms and conditions. Upon completion of the payment process, ePay's system automatically redirects you back to the Platform. You will be granted access to the Service upon confirmation from ePay of a successful payment.
Payment via the Stripe platform - according to the Stripe payment terms available at www.stripe.com . On the payment screen, the User should enter his/her debit/credit card details and a secret identification code, after which the card payment is authorised. Upon successful payment, Stripe returns a response about the successful transaction. In case of unsuccessful payment, Stripe returns a response for the failed transaction.
You can pay online with any Visa/Visa Electron/MasterCard or AMEX card through the Stripe platform.
The Stripe platform provides the ability to make automatic payments to NetHost.BG by direct debit from the User's bank card. When NetHost.BG issues a Proforma Invoice for a service requested by the User, Stripe automatically withdraws from the specified bank card the amount required to pay the Proforma Invoice issued by NetHost.BG. After successful payment, NetHost.BG sends the invoice to the User directly by e-mail.
Via EasyPay - in accordance with the EasyPay payment terms available at www.easypay.bg . Payment can be made at one of Easypay's 1,500 counters nationwide. EasyPay cash desks are also available in most branches of First Investment Bank, Office 1 Superstore, Central Cooperative Bank, D Bank, TeximBank, Billa, Piccadilly, Fantastico, etc.

COOKIE POLICY
NetHost.BG uses information gathering technologies called cookies, which are small amounts of information that a web server sends to a web browser and allows the server to collect feedback from the browser.
By using the NetHost.BG website, the User agrees to the Cookie Policy.
The Provider has the right to use cookies to provide the User with a better experience on NetHost.BG and to offer the most relevant service to the User.
The Provider has the right to prepare anonymous statistics that help it understand how the User prefers to use the NetHost.BG pages in order to improve their structure and content, excluding the identification of the User's identity.

- for site performance;
- to analyse visitors to the site;
- for geographical targeting;
- for registration;
- for advertising.
The user can delete cookies through the options of each browser;
The Provider reserves the right to change the Cookie Policy at any time.
In view of the fact that we provide services to our customers remotely by electronic means and in accordance with the legislation in force in the country, the agreement to the terms and conditions in the ordering process has the force of a contract concluded at a distance. We have no practice of entering into individual paper contracts with individual customers.
